Статья посвящена исследованию правового регулирования имущественных отно шений супругов в российском семейном праве с учетом действия законного и договорного режимов собственности. Рассматриваются правовая природа каждого режима, основания их применения, особенности формирования и реализации имущественных прав супругов в период брака и при его растор жении. Особое внимание уделено содержанию и пределам брачного договора, судебным механизмам защиты прав сторон, а также проблемам правоприменения, возникающим при разделе имущества и взаимодействии супругов с кредиторами. На основе анализа действующего законодательства и прак тики его применения обосновывается значение осознанного выбора режима имущества супругов для обеспечения баланса частных интересов, правовой определенности и устойчивости семейных имуще ственных отношений

The article examines the legal regulation of spouses’ property relations in Russian family law, taking into account the operation of the statutory and contractual property regimes. The legal nature of each regime, the grounds for their application, and the specific features of the formation and exercise of spouses’ property rights during marriage and upon itsdissolution are analyzed. Particular attention is paid to the content and limits of marital agreements, judicial mechanisms for the protection of the parties’ rights, aswell as law-enforcement issues arising in the division of property and in relations between spouses and creditors. Based on an analysis of current legislation and its application in practice, the article substantiates the importance of an informed choice of the property regime of spouses to ensure a balance of private interests, legal certainty, and the stability of family property relations.
