<p>This article examines the doctrines of res judicata and issue estoppel in international commercial and investment arbitration, focusing on their theoretical foundations, practical application, and relevance for Russian law. It distinguishes between cause of action estoppel, which precludes the relitigation of identical claims, and issue estoppel, which prevents parties from reopening issues of fact or law that have already been conclusively determined in prior proceedings. The study analyses the historical development of these doctrines in common law, comp judgments, and explores the methodologic Drawing on the jurisprudence of English, Swiss, French and U.S. courts, as well as the practice of the ICAC at the Russian Chamber of Commerce and Industry and Russian state courts, the article demonstr that preclusive effect has become recognised as a general principle of international arbitration despite the absence of comprehensive statutory regulation. Particular attention is devoted to the criteria for applying issue estoppel, including identity of issues, finality of the prior decision, and the concept of privity. The article concludes by evaluating the current state of Russian law and proposing reforms aimed at strengthening legal certainty through clearer regulation of the preclusive effect of judicial and arbitral decisions in subsequent arbitral proceedings.</p>
<kwd-group xml:lang="ru"><kwd>res judicata</kwd><kwd>issue estoppel</kwd><kwd>преюдиция</kwd><kwd>законная сила судебного решения</kwd><kwd>международный коммерческий арбитраж</kwd><kwd>параллельные разбирательства</kwd><kwd>публичный порядок</kwd></kwd-group><kwd-group xml:lang="en"><kwd>res judicata</kwd><kwd>issue estoppel</kwd><kwd>preclusion</kwd><kwd>legal force of a judgment</kwd><kwd>international commercial arbitration</kwd><kwd>parallel proceedings</kwd><kwd>public policy</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">Асосков А.В.
