<p>The article examines the international legal nature of BRICS financial cooperation and the legal forms required for its institutionalisation. BRICS is not an international organisation endowed with legal personality, although a multirlevel norm-law instruments with legally binding international treaties. The study determines which legal form is appropriate for different types of financial cooperation between states. Its methodology combines form legal and institutional analysis, including examination of the agreements establishing the New Development Bank and the Contingent Reserve Arrangement. The research finds that declaratory instruments rem effective for coordinating objectives, principles and technical standards but become insufficient when states create payment, settlement, depository, digital and guarantee infrastructure. Such mechanisms affect property rights, settlement finality, applicable law, allocation of liability, inform The article substantiates a modul BRICS financial infrastructure, optional protocols for individual projects and model rules for national legislation. This approach preserves intergovernment legal certainty required for financial initiatives. The findings m development of the BRICS treaty framework and the coordination of crossrborder financial mechanisms.</p>
<kwd-group xml:lang="ru"><kwd>БРИКС</kwd><kwd>международное право</kwd><kwd>мягкое право</kwd><kwd>международные договоры</kwd><kwd>международные организации</kwd><kwd>Новый банк развития</kwd><kwd>трансграничные платежи</kwd><kwd>цифровые права</kwd><kwd>финансовая инфраструктура</kwd></kwd-group><kwd-group xml:lang="en"><kwd>BRICS</kwd><kwd>international law</kwd><kwd>soft law</kwd><kwd>international treaties</kwd><kwd>international organisations</kwd><kwd>New Development B</kwd><kwd>digital rights</kwd><kwd>financial infrastructure</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">БРИКС в мировых финансах и экономике: монография / Г.
