В XVII в.
<p>The article examines the evolution of criminal punishment in Russia from the sixteenth to the eighteenth century as a transformation of both sanctions and their political and legal functions. Drawing on the 1550 Sudebnik, the 1649 Sobornoye Ulozhenie, the 1715 Military Article, imperial decrees, and Catherine II’s Instruction, the study identifies the transition from an estate-based repressive model to a state-utilitarian penal system. In the sixteenth century, punishment supported political centralization, public deterrence, and the removal of “dashing people,” while imprisonment only began to develop as an independent sanction. During the seventeenth century, capital, corporal, dishonouring, property, custodial, and exile penalties were expanded and differentiated; punishment protected the sovereign’s order and reproduced estate hierarchy. Petrine legislation gave repression a disciplinary and mobilizational function by linking penal servitude and exile to the needs of the army, navy, construction projects, and territorial colonization. In the second half of the eighteenth century, a conflict emerged between doctrines restricting torture and capital punishment and the continued use of harsh corporal and estate-dependent practices. The article concludes that humanization was nonlinear: reduced physical destruction was accompanied by institutionalized forced labour, administrative isolation, and deprivation of legal status.</p>
<kwd-group xml:lang="ru"><kwd>уголовное наказание</kwd><kwd>Судебник 1550 г</kwd><kwd>Соборное уложение</kwd><kwd>Артикул воинский</kwd><kwd>смертная казнь</kwd><kwd>телесные наказания</kwd><kwd>тюрьма</kwd><kwd>ссылка</kwd><kwd>каторга</kwd><kwd>гуманизация</kwd></kwd-group><kwd-group xml:lang="en"><kwd>criminal punishment</kwd><kwd>Sudebnik of 1550</kwd><kwd>Sobornoye Ulozhenie</kwd><kwd>Military Article</kwd><kwd>death penalty</kwd><kwd>corporal punishment</kwd><kwd>imprisonment</kwd><kwd>exile</kwd><kwd>penal servitude</kwd><kwd>humanization</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">[1] Судебник 1550 г.
