Работа посвящена исследованию некоторых дискуссионных аспектов проектов нормативных правовых актов, посвященных регламентации состава и содержания проектной документации по сохранению и изучению объектов культурного наследия. Обосновано, что наиболее дискуссионным является требование о включении в состав документации сводного сметного расчета. Аргументировано, что потенциальная регламентация, обладая несомненными достоинствами, в рассматриваемой части обнаруживает дополнительную проблематику правового регулирования, потребует дополнительных усилий законодателя по гармонизации законодательства, оказывает прямое воздействие на правовое положение как частных, так и публичных субъектов. По итогам исследования обращено внимание на то, что предлагаемые новеллы, в том числе, намечают тенденцию изменения подходов законодателя к системе государственной историко-культурной экспертизы, что подлежит дальнейшему изучению и разработке.

The work is devoted to the study of certain controversial aspects of draft regulatory legal acts devoted to regulating the composition and content of project documentation for the preservation and study of cultural heritage sites. It is substantiated that the most controversial requirement is the inclusion of a consolidated cost estimate in the documentation. It has been argued that the potential regulation, while possessing undeniable advantages, reveals additional problems in the area of legal regulation in the context under consideration, will require additional efforts by the legislator to harmonize the legislation, and has a direct impact on the legal status of both private and public entities. Based on the study’s findings, attention has been drawn to the fact that the proposed innovations, among other things, indicate a trend towards a change in the legislator’s approach to the system of state historical and cultural expertise, which requires further study and development.
