Статья посвящена особенностям цифрового взаимодействия при регистрации сделок с недвижимостью на примере договоров участия в долевом строительстве (ДДУ) и уступки прав требования по ним. Электронная подпись рассматривается как ключевой элемент легитимации сделки в электронной форме и одновременно как фактор, порождающий специфические риски: от вопросов надлежащего удостоверения волеизъявления до технических и процедурных проблем при подаче документов в Росреестр. В работе проанализированы требования к электронным документам, порядок использования УКЭП, а также типичные основания для возврата документов без рассмотрения либо приостановления регистрации. На базе судебной и административной практики выделены проблемные зоны, связанные с идентификацией сторон и подтверждением полномочий, и предложены направления минимизации рисков при переходе на полностью электронный формат взаимодействия.

The article examines the specifics of digital interaction in the registration of real estate transactions, using as examples shared construction participation agreements (DDU) and the assignment of claims thereunder. The electronic signature is considered as a key element for legitimizing a transaction in electronic form and, at the same time, as a factor generating specific risks — ranging from issues related to the proper verification of the parties' expression of will to technical and procedural problems encountered when submitting documents to Rosreestr. The paper analyzes the requirements for electronic documents, the procedure for using an enhanced qualified electronic signature (EQES), as well as typical grounds for returning documents without consideration or suspending the registration process. Based on judicial and administrative practice, the study identifies problem areas related to the identification of parties and the confirmation of their authority, and proposes ways to minimize risks when transitioning to a fully electronic format of interaction.
